Acceptance
By ticking the box "I declare that I have read and accepted the applicable general terms and conditions of sale without restriction" and validating the payment, the customer confirms that they have read and accepted all the general terms and conditions of sale to the exclusion of any other general terms and conditions, unless otherwise agreed by the seller.
Quotes, purchase orders and invoices are subject to the general terms and conditions of sale and imply full acceptance by the customer.
Order
An order confirmation is sent by email to the address provided by the customer. VITAKER.FR reserves the right to cancel any customer order in the event of a dispute concerning payment for a previous order.
When placing an order, the information provided is the responsibility of the customer. Orders are sent only to the postal address provided by the customer. In the event of an error in the recipient's contact information, the seller is not liable for the inability to deliver the goods.
Delivery
After confirmation of the order, VITAKER.FR undertakes to deliver to its carrier all the references ordered by the buyer within a maximum period of 30 days (from the day after receipt of the order).
Products purchased on VITAKER.FR are delivered in metropolitan France, in EU countries and outside the EU, by Colissimo postal services with tracking or UPS.
The indicated delivery times are typical averages and include processing and shipping. If items are available for delivery on different dates, the delivery time will be based on the longest estimated delivery time. VITAKER.FR reserves the right to split shipments; you will only be charged for the items that are actually shipped. Shipping and handling fees will only be charged once.
VITAKER.FR cannot be held responsible for consequences due to a delivery delay.
Any order not shipped within 30 days of the order will be cancelled unless otherwise stipulated and announced in the sales offer.
In the case of pre-orders, the thirty-day period runs from the official release date of the pre-ordered product.
The customer must notify the carrier and VITAKER.FR of any issues with the delivered product (damaged or already opened package, etc.) within three days of receiving it. In the case of a technical product, the customer should carefully check that the delivered device is functioning correctly and read the instruction manual provided.
In the event of apparent defects, the customer has the right to return the product under the conditions set out in this document.
Furthermore, for deliveries outside of mainland France, the customer agrees to pay all taxes due on the importation of products, customs duties, value added tax, and all other taxes due under the laws of the country of receipt of the order.
In the case of pre-orders, VITAKER.FR undertakes to deliver to its carrier all the references ordered by the buyer within a maximum period of 15 working days after the official release date of the pre-ordered product.
Cancellation and Returns
The customer has 14 days from the day after receiving the order to exercise their right of withdrawal, without having to justify their decision.
However, certain categories of products cannot be returned in accordance with Article L221-28 of the Consumer Code: personalized products, hygiene products, single-use products, unsealed products that cannot be returned for reasons of hygiene or health protection, as well as liquid products.
To exercise their right of withdrawal, the customer must contact customer service at the following address: contact@vitaker.fr
specifying your order number.
Products must be returned new, complete, unused, unopened, in their original packaging, accompanied by all accessories.
Return shipping costs are the responsibility of the customer.
VITAKER.FR does not cover the return shipping costs.
Upon receipt of the conforming product, VITAKER.FR will proceed with the refund of the sums paid, including the price of the products, within a maximum period of 14 days, using the same payment method as that used when ordering.
No direct exchange takes place.
To obtain another product, it is up to the customer to place a new order after receiving a refund.
Price
The price is expressed in Euros. The price is shown excluding tax (HT) and including all taxes (TTC). The product price shown in the catalog corresponds only to the product price, without the shipping cost. The final price charged to the customer is the price shown during online payment. For France and other European Union countries, the final price includes VAT and all other taxes.
The discount code must be entered in the designated field in the shopping cart before the payment step. Discount codes cannot be combined. Once the order is paid for and confirmed, the discount code cannot be used for that order afterward.
VITAKER.FR reserves the right to change prices at any time. However, for any accepted order, VITAKER.FR guarantees the prices in effect on the date of order confirmation by VITAKER.FR.
Payment
The price of the products is payable in full on the day the order is placed, and payment is made by credit card bearing the CB logo, via PayPal. You can also pay by bank transfer by following the instructions provided throughout the purchase process. However, please note that when paying by bank transfer, due to processing times and as indicated on our website, the delivery time for your order will be recalculated from the date of validation by our accounting department.
The order validated by the customer will only be considered effective once the relevant banking payment centers have given their approval. In the event of refusal by these centers, the order will be automatically canceled and the customer notified by email. Furthermore, VITAKER.FR reserves the right to refuse any order from a customer with whom there is an existing dispute.
We use the Shopify payment process for all online transactions, Shopify Payments.

VITAKER.FR's liability is systematically limited to the value of the product in question, value at its date of sale, and this without any possibility of recourse against the brand or the company producing the product.
All orders placed on VITAKER.FR are for the personal use of the customer. Customers and recipients of the products are prohibited from reselling the products, either partially or in full. VITAKER.FR disclaims all legal responsibility if the customer fails to pay any applicable taxes.
In any event, the customer benefits from the legal guarantee against eviction and hidden defects (Articles 1625 et seq. of the Civil Code), provided that the buyer proves the existence of the hidden defect. The seller is legally obligated to remedy all its consequences (Articles 1641 et seq. of the Civil Code). If the buyer takes legal action, they must do so within a "short period" from the discovery of the hidden defect (Article 1648 of the Civil Code).
Personal information
Providing the personal information collected for the purposes of distance selling is mandatory, as this information is essential for processing and shipping orders, issuing invoices, and establishing warranty contracts. Failure to provide this information will result in the order not being validated.

It will only be used to process the customer's order and to enhance and personalize communication regarding products reserved for VITAKER.FR customers, particularly through VITAKER.FR newsletters to which the customer has subscribed, and for personalizing the website based on your interests.

Disputes
This contract is governed by French law. VITAKER.FR cannot be held liable for damages of any kind, whether material, immaterial, or physical, that may result from the malfunction or misuse of the products sold. The same applies to any modifications to the products made by the manufacturers. In any event, VITAKER.FR's liability will be limited to the amount of the order and cannot be invoked for simple errors or omissions that may have occurred despite all precautions taken in the presentation of the products.
In the event of difficulties in the application of this contract, the customer has the option, before taking any legal action, to seek an amicable solution, in particular with the assistance of a professional association in the relevant sector, a consumer association, or any other advisor of their choice. It is important to note that seeking an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is also important to note that, as a general rule and subject to the discretion of the courts, compliance with the provisions of this contract relating to the contractual guarantee requires that the buyer fulfill their financial obligations to the seller.
Complaints or requests for information will always be carefully reviewed, as the customer's good faith is presumed. In case of difficulty, the customer is encouraged to contact customer service first to seek an amicable solution.
In the absence of an amicable resolution:
- For consumer clients (individuals): the competent court is that of the client's place of residence , in accordance with Article R.631-3 of the Consumer Code.
- For business customers : the Commercial Court of Pontoise will have exclusive jurisdiction, regardless of the place of delivery or the method of payment used.
